Explanation of Trump’s New Executive Order on Immigration
1. President Trump signed an executive order on Wednesday, April 22, 2020, that temporarily suspends some immigrants from entering the U.S. for 60 days.
2020年4月22日，星期三，川普签署总统令，限制一些移民进入美国，为期60天。
2. The order only applies to a limited number of foreign nationals who are currently outside of the United States and who are seeking to enter the U.S. as immigrants.
这个总统令只限制目前身在美国境外，并且寻求用移民身份进入美国的一些人。
3. People who are inside the United States are not affected. Their immigration petitions and visa status applications, including I-140, I-130, I-485, I-765, I-131, I-129, I-539, N-400, etc., can still be received, processed, and approved by the USCIS.
4. People who currently hold valid non-immigrant visas such as H-1B, F-1, J-1, L-1, O-1, K-1, B-2, etc., and their dependents who hold valid dependent visas, are not affected. They may continue to enter the U.S., but of course they are still subject to other travel restrictions previously imposed due to the pandemic.
5. People who have already received their valid immigrant visas are also not affected. The immigrant visa is usually valid for 6 months.

6. People who currently hold valid U.S. greencard or unexpired Advance Parole are also not affected.
目前持有绿卡，或者持有有效回美证（Advance Parole）的人也不受影响。
7. Other Exceptions and Waivers include: EB-5 applicants, Spouse and Children of U.S. citizens, Spouse and Children of U.S. military members, Medical Workers and their spouse and children, other individuals whose entries are deemed as benefiting U.S. national interest, etc.
8. Then, exactly who are really affected? And why signing this Executive Order?

9. Theoretically, certain family-based immigrants and employment-based immigrants, who are not included in the long lists above, including: spouse and children of U.S. permanent residents, parents and siblings of U.S. citizens, some EB-1,2,3,4 applicants, may be affected, IF they do not already have immigrant visa, do not have other valid non-immigrant visas, and do not meet any of the exceptions above.
10. However, since the visa services, including the issuance of new immigrant visas, are already mostly stopped due to the pandemic, the real impact is quite limited. This executive order is probably issued with some political calculations.
11. This executive order is set to expire in 60 days but may be extended. In addition, the executive order also asks the Secretary of Labor and the Secretary of Homeland Security, in consultation with the Secretary of State, to review nonimmigrant programs within 30 days, indicating there can be more upcoming changes.
