In some states, DUI-related fatalities can be charged as manslaughter, vehicular homicide, or even murder, depending on the circumstances. Should causing a fatal crash while driving under the influence (DUI) be considered murder?

As a retired first responder, I have seen the devastation they cause. And I have seen how they NEVER take personal responsibility. It is always somebody else's fault they drive drunk.

According to the legal definitions, I believe it would constitute as manslaughter. But I know that on an emotional level, we would want the culprit charged with murder.

DIL has her 2nd DUI. It's proven they have driven drunk many times before getting caught. Pretty sure our young grandkids have been in the car. She does not want to get help with her addictions.

Hell yes. If you get behind the wheel of a vehicle while inebriated, you are saying that you are ok with creating a scenario that is likely to result in injury or death.

In the UK dui, road fatalities are charged as death by dangerous driving with a minimum sentence of 14 years

Yes their direct actions cause the death they chose to drink and drive so they must pay the price of those actions it baffles me anyways that we allow a small amount to be consumed and still drive

In Ms it's called aggravated dui, and it carries up too 25years max in prison. I know a kid who had an accident at 18 ,where someone died ,and he was drinking . His trial just finished recently after 4 years ,he got 20 years in jail! Don't drink and drive!

In repeats yes. Because sometimes you may not want to drive and you find out the hard way you're surrounded by bad friends that made you.

My great aunt was hit and killed by a drunk driver, while she was getting her mail. He took off but luckily a neighbor got the license place. He got a slap on the wrist because he agreed to go to rehab. He murdered my Aunt. And he gets to walk free, absolute bullshit. There are so many options available, Uber, Lyft, etc.

"Causing" is an important word. If the person injured or killed caused the accident and the person high or over the limit did nothing to contribute, in most states the person with a few drinks goes to prison for DUI manslaughter or bodily harm.

I was in a crash years ago that took the life of my best friend. I had inactive THC in my blood. I was not intoxicated in the slightest, but according to my state’s laws I was DUI due to the trace amounts of controlled substance in my blood. Medical marijuana was legal even back then, which meant that a person could smoke their prescribed medical marijuana and then three weeks later still be legally DUI if traces of it were still present in their blood. Never assume a DUI means someone was intoxicated, and never jump to conclusions and wish for serious charges and long prison sentences.

Murder needs to be a conscious decision to murder. How is that so hard to understand or agree on? Plenty of poor choices, that are made by individuals, can be a leading factor in the bad outcomes of themselves or others, but it doesn’t make it the cause of the bad outcome. The “guilty mind” is too essential to the principles of justice to be ignoring. No drunk driver, that I’m aware of, has ever intended to kill someone. Rather, 100% of them are accidents.

It should be charged as murder, a person makes a conscious decision to drink then get behind the wheel....and its so preventable.
