Should burning the American flag be considered protected speech under the First Amendment, or should it be subject to prosecution?

@Adiscretefirm

Protecting the speech you disagree with is the true test of your values

I fought to protect this. I don't agree with it, but it is their right. Unfortunately, they don't understand that my Second Amendment protects their 1st Amendment.

The question is a too vague for me. If it's your flag it's free speech; if it's someone else it's destroying someone's property.

@samtjman

Protected, but still subject to general laws against burning things in public.

If you get arrested for defacing a pride flag, then the same should go for the American flag.

Slippery slope. This can absolutely be used as a starting point to take more free speech rights away.

The most beautiful thing about the country is that you can openly protest against it and be allowed to do so

I think if someone doesn't want to be America instead of us constantly paying taxes for them we should give them a free one-way flight to the country of their choice ‼️👋

A flag is nothing but a piece of fabric. But the ideals we fought and bled for, the Constitution and our Democracy ARE worth fighting for. It’s what it represents, that is important—it is a symbol.

Protected speech is just that. Speech. Actions are subject to consequences.

Just remember, every time a U. S. flag is burning it. Could be one that was draped over the coffin of a man or woman that gave their life to defend that flag. Some times having a right doesn't make it right.

I am a free speech absolutist, even for shit i vehemently disagree with. As long as you legally acquired it, you have that right

You burn the Stars and Bars, you go straight to Alligator Alcatraz.

@lscizml

It already is considered free speech per the supreme court.

My brother, who fought in the army and lost friends, said to me when he heard about people burning the flag in protest, "better not do it around me."

It's the symbol of the GREATEST COUNTRY in the world!!! So it should absolutely be a federally prosecuted crime.

Potected. Now violating any open burn laws should be prosecuted in the fullest.
