They have no legal basis to try and court martial him. Not following unlawful/illegal orders is taught in basic for every branch. Our oath is to the Constitution of the United States, not whichever person is sitting in the White House. This also includes orders that violate Geneva Convention.

I’d recommend people watch the Legal Eagle video they did earlier this year on whether or not Soldiers can defy orders. They do a good job of explaining just how complicated it is for them to actually disobey. The whole system is built on complete obedience.
