In beauty and personal care, transparency and compliance with regulations are not just important—they are essential. Unfortunately, my company, Meticulous Manicurist, recently encountered a situation that forced us to make a difficult but necessary decision.
As the North American distributor for the product “Nail Mycosis” we were told the product met all FDA regulations. At the beginning of the relationship, our company provided the FDA monograph to the company to ensure they understood compliance in the USA. However, alarm bells started ringing when the company began changing the ingredients, label contents, and then the product name without providing us with any explanation or transparency. Our repeated requests for information were met with silence, leaving us in the dark about the product’s legality. The final straw was when US Customs held another shipment (they had changed the product name and ingredients in an attempt to pass through customs again), and customs finally mailed us paperwork explaining the product was not FDA compliant. (To date the ingredients were changed more than 8 times and the last change only contains 4 of the original ingredients with the addition of 7 others.)
We soon realized that the company was deliberately withholding critical information, manipulating our influence and reputation to continue promoting a product that was not compliant. They used our reputation and influence to gain the public's trust while knowingly not following the rules set by the FDA. This was not just a breach of trust but an apparent attempt to deceive us and the public. As a company that prides itself on maintaining the highest standards for compliance and integrity, we could not accept this behavior. The agreement with their company as the North American distributor included growing a network of professionals to sell the product by licensed professionals in salons and medical offices. They broke their agreement by listing the non-compliant product on Amazon, directly undercutting the ability of all current retailers to maintain sales levels.
