5 Dinge, bei denen ich als Arbeitsrechtsanwalt richtig froh bin, dass meine Freunde sie machen 👇
1. Sie halten Fristen ein.
Anfechtung einer Kündigung, Widerspruch, Geltendmachung von Ansprüchen — im Arbeitsrecht sind viele Fristen kurz und laufen ab dem Zugang der Erklärung, nicht ab dem Moment, in dem man sich Gedanken macht. Wer erst nach Wochen fragt, hat oft schon verloren, was rechtlich möglich gewesen wäre.
2. Sie lassen sich beraten, bevor sie handeln.
Der Unterschied zwischen "Ich hab schon unterschrieben, ist das okay?" und "Ich soll morgen unterschreiben, ist das okay?" ist für mich als Anwalt der Unterschied zwischen Schadensbegrenzung und echter Gestaltungsmöglichkeit.
3. Sie beantworten unzulässige Fragen im Bewerbungsgespräch nicht wahrheitsgemäß.
Fragen nach Schwangerschaft, Behinderungen oder Familienplanung sind grundsätzlich unzulässig — und bei solchen Fragen besteht sogar ein "Recht zur Lüge". Wer hier ehrlich antwortet, riskiert Diskriminierung, ohne dass es ihm etwas bringt.
4. Sie halten Absprachen schriftlich fest.
"Das hat mein Chef mir mündlich zugesagt" ist im Streitfall schwer zu beweisen. Eine kurze Bestätigungs-E-Mail nach dem Gespräch kostet zwei Minuten und ist im Zweifel Gold wert.
5. Sie unterschreiben nichts vorschnell.
Gerade Auflösungsvereinbarungen werden gern im Gespräch "schnell noch" unterschrieben. Es gibt kein Gesetz, das eine sofortige Unterschrift verlangt — eine Nacht Bedenkzeit und ein kurzer Blick von außen sind fast immer möglich.

There’s a new scam targeting international students..

How do I know this?

In recent weeks I’ve had several international students reach out to me with pleas for help. After submitting their documents for a student residence permit in Austria, authorities gave them shocking news: The rental agreements that the students provided as part of their application package were fake.

These students had paid agents in their home countries to help them get a local rental agreement in Austria. And it appears that these agents took the money without providing a proper service.

The international students now find themselves in a lot of trouble: Normally, the immigration authorities will only give them a few weeks to amend their applications by providing an appropriate rental agreement. Otherwise, they could face their applications being rejected.

Such rental agreements are not easy to come by, especially at the beginning of an academic year when many international students are looking for new accommodation. Many landlords are hesitant to rent out to students - especially if it is not yet clear whether they will even be admitted to move to Austria.

The best tip I can give here: Reach out to the student unions and admission offices at the universities that you’re enrolling for. Ask them for a list of trusted student housing facilities close to campus.

Why I care?

I was an international student as part of my education as well. And it breaks my heart to see people being exploited and facing hardship that may put their academic future in jeopardy.
