To establish stronger protections against violence targeting African American communities, to ensure prosecution of such offenses, and to impose penalties including fines and imprisonment.
SECTION 1. SHORT TITLE.
This Act may be cited as the “African American Community Protection and Justice Act of 2025.”
SECTION 2. FINDINGS AND PURPOSE.
Congress finds that—
1. African American communities have historically faced disproportionate levels of violence, discrimination, and hate crimes.
2. Hate-motivated acts undermine public safety, civil rights, and the principles of equality under the law.
3. Stronger measures are needed to deter, prosecute, and penalize acts of violence directed at African American individuals and communities.
The purpose of this Act is to—
• Protect African American communities from targeted violence.
• Ensure that perpetrators are prosecuted to the fullest extent of the law.
• Impose appropriate penalties, including fines and imprisonment, to deter future offenses.
SECTION 3. DEFINITIONS.
For the purposes of this Act—
1. “Targeted violence” means any act of physical harm, threat, intimidation, or destruction of property motivated in whole or in part by the victim’s race or association with African American communities.
2. “Community institution” means a church, school, cultural center, business, or other establishment serving primarily African American populations.
3. “Attorney General” refers to the Attorney General of the United States.
SECTION 4. PROHIBITIONS.
(a) It shall be unlawful for any person to—
1. Commit, attempt, or conspire to commit violence against any individual or group on the basis of their African American identity.
2. Damage, deface, or destroy property owned by, or associated with, African American communities for the purpose of intimidation or harm.
3. Use threats, harassment, or intimidation with the intent to cause fear or prevent the free exercise of civil rights.
SECTION 5. PENALTIES.
(a) Any person found guilty of violating Section 4 shall—
1. Be fined not less than $10,000 and not more than $250,000.
2. Be imprisoned for not less than 5 years and not more than 25 years, depending on the severity of the offense.
3. Be liable for restitution to victims, including costs for medical care, counseling, property repair, and community restoration.
(b) If death results from an offense under this Act, the perpetrator shall be subject to life imprisonment.
SECTION 6. ENFORCEMENT.
(a) The Attorney General shall establish a task force dedicated to investigating and prosecuting acts of violence against African American communities.
(b) Federal, state, and local law enforcement agencies shall coordinate to ensure prompt reporting, investigation, and prosecution.
(c) Grants shall be provided to community institutions for security measures, education, and victim support services.
SECTION 7. SEVERABILITY.
If any provision of this Act is held unconstitutional, the remainder shall not be affected.
