The Death Penalty in 2026: An Effective Deterrent or Another Outdated Relic of The American Criminal Justice System?

The death penalty remains one of the most debated issues in the American criminal justice system, and states continue taking very different approaches to capital punishment. Supporters argue it delivers justice for victims and their families, provides the ultimate punishment for the most horrific crimes, and may discourage future acts of violence. Opponents question whether the government should have the authority to take a life, pointing to wrongful convictions, racial disparities, high costs, and human rights concerns.

The divide is especially clear today. Florida had the highest number of executions totaling 19 in 2025, which was the highest total in the nation.

In Ohio executions have been delayed by Governor Mike DeWine, who was once a supporter of the death penalty. He has publicly stated he no longer believes the death penalty is the answer to curb violent crimes.

Supporters of capital punishment believe some crimes deserve the ultimate punishment and that executions provide justice for victims’ families while protecting society. An often cited take on this was provided by economist Isaac Ehrlich’s in 1975. His study suggested executions deter murder and was referred to in the 1976 Supreme Court case which overturned the courts 1972 decision to ban capital punishment in the U.S.

However, later research challenged his methods, and major scientific reviews found no reliable evidence that the death penalty deters murder more effectively than life imprisonment.

Advances in DNA testing and the work of organizations like the Innocence Project have overturned numerous wrongful convictions, raising questions about the reliability of the justice system. In addition, critics note that death penalty cases often cost taxpayers more than sentencing someone to life without parole because of lengthy trials and appeals.

As laws, technology, and public opinion continue to evolve, one question remains: Is it time for America to end the death penalty, or does it still have a place in the pursuit of justice?
