A Bench of Justices Dipankar Datta and A G Masih held that such exclusion violates Articles 14 and 16 of the Constitution, which guarantee equality and equal opportunity in public employment.
Upholding a #RajasthanHighCourt ruling, the court clarified that the #opencategory is not a quota, but a merit-based pool open to all candidates, and directed recruitment authorities to prepare open merit lists first, before drawing reserved category lists.
