On this channel we explain legal topics and do analyses of current trials. My goal is to explain complex legal topics in ways that don't require you to have a Latin-to-English dictionary. Why?
The law can be an astoundingly complex thing. For any question there are multiple possible answers. My job is to explain things in plain language.
Importantly, this channel DOES NOT provide legal advice. It is a general description of the law based on 28 years of legal practice, hundreds of case, and lots of experiences. As a lawyer I have written a legal column for more than 25 years and am published in a wide variety of publications. I have several books published both in hardback and in Kindle format.

It's been a bad week for state court judges. A New Mexico judge was arrested and banned from the judiciary for life after he was alleged to be harboring illegal alien gang members. Judge Dugan in Milwaukee was arrested and charged with federal felonies. And now, a judge in Martin County, Florida, was arrested on drug charges with cocaine allegedly found in the judge's wallet and his two passengers charged with possession of cocaine. They say bad things come in threes. Hopefully we won't see any more judges arrested.

I watched the hearing today in Read. Brennan is the nastiest cross-examiner I have ever seen. If you were playing a drinking game and took a shot every time she said "I'll allow it" for Brennan, you'd have been drunk ten minutes in.

The State's Closing in the Daybell case was long, but it was detailed. It addressed the conspiracy, the intent, the motives, and the way the physical evidence did not add up. It also showed that Lori conspired with Alex and Chad using the "we got rid of him" text quite effectively. It was measured, dispassionate, nothing to raise an issue of inflammatory rhetoric. The only thing I noticed was it appeared she was looking hard at Daybell at different times, but I think I just didn't realize where she had positioned her computer for her slide show. All in all, it's strong B+ closing. I took points off for length, and failure to wrap up after the judge asked. Can't wait for Lori's rebuttal - if any.

So Lori Daybell rested her case - sort of - today. She said she would decide for sure over the weekend and let the judge know if she wanted to testify on Monday. She apparently has no witnesses to call. On Friday, if I can get to it, I will lay out what Daybell needs to do to avoid a conviction, and what she absolutely should not do (testify).

GUILTY on both counts. It would appear the jury worked all day and decided not to come back next week. This is the beauty of having deliberations begin on a Friday. No one wanted to come back.

I'm thinking maybe Mr. Muller, doing the defense closing, is just filibustering because he can't really address the evidence of all her lies. He just called out the fire investigator, Leroy, and called him a liar. That's pretty rich coming from the guy representing the woman who changed her story the way most people change their socks!
