Does anyone else randomly think about the 2002 Brazil World Cup team? I admit I am only an occasional football viewer, once every 4 years to be precise šŸ˜… , following all the FIFA World Cups since 2002 and that was such a solid team and they played so well. Ronaldo, Ronaldinho, Rivaldo, Roberto Carlos, so many legends. Ronaldo in particular the star, this was the original Ronaldo before our Portuguese friend came along lol. And that German team was no joke: the goalkeeper Oliver Kahn in particular, one of the best of all time, played a key role in getting Germany to the finals. FREE FLOWING MUSINGS ON LAW, RECENT TRAGEDIES & SOCIETY

Lawyers have been hated for centuries. Unfortunately I cannot 100% defend all the stereotypes: there are awful people in our profession. To be fair, that can be said about EVERY profession in every country from the time every profession began in history I suppose , but I’m not going to try to downplay or deny that many have acted in unethical ways, for personal, financial or political gain, which has harmed others. I think there are also a lot of misconceptions about how/why things are the way they are, how the courts operate, people not understanding ā€œcab rank ruleā€, etc etc.

People rush to lawyers when in trouble, so many family & friends see their legal relatives as their ā€œget out of troubleā€ cards, the profession stood up for the nation during the ā€œaragalayaā€ time, but then in the years since, the vilification recommenced. Recently, a cop slapped a lawyer, and while the lawyer ought not to have made such a spectacle in public which led to him being viewed as the aggressor in the situation due to the optics, honouring the cop with a wreath the next day (the same type of cops many lawyers help victims of police brutality & wrongdoing against) was a very disappointing sight.

That being said, the profession also should do more. We are all in shock and sorrow at the recent cold-blooded roadside murder of a lawyer and his wife, connected to his professional dealings. 2 young lives lost, many grieving, I am glad it is being taken seriously, as evinced by yesterday’s Bar Association meeting decision, GMOA support for it etc etc and Mr Rajeev Amarasuriya, BASL President, is a gentleman truly committed to the advancement and protection of the legal profession. While I did think about some innocent litigants with troubles who haven’t contributed to vilification of lawyers who would have been inconvenienced by today’s non-appearance, I can understand the rationale behind this symbolic stance pertaining to the rights and expectations of lawyers to do their jobs safely, especially given that recently lawyers were harassed outside Nugegoda court as well.

However, I’d like to take this moment to bring up 2 other deaths of lawyers which also should have triggered a wide response but didn’t, most likely because many people thought such circumstances wouldn’t affect them. This is not to detract from the gravity of the recent brutal killings, but to add to the overall discussion.

A young counsel took his own life in 2024. This should have been a sign for the legal profession to take mental health issues seriously. Lawyers have a very high rate of alcoholism, drug use, relationship problems & infidelity worldwide, it is a high pressure, time-consuming profession, often unreliable incomes, the lifestyle often brings health issues, many times underappreciated and scorned and so people can develop stress, anxiety, depression, etc. This should have been an eye-opener, a sign for everyone to not lose sight of their well-being, to look after their juniors and colleagues and watch out for each other. But after a while chatter died down. Some were more interested in gossiping about why/how the incident happened rather than what lesson to take from this shocking loss of a brilliant and wonderful young man, one of my best friends, and the chatter died down. I heard that some mental health workshops were going to happen but I don’t think they did.

A lady lawyer was also brutally murdered in her home by the former household driver in horrifying and deeply tragic circumstances in 2024. Yes, this had nothing to do with profession, it was the driver stalking and harassing her and his own personal evil tendencies, but all lawyers should have been outraged at this and taken a stand. This should have been an opportunity to highlight violence against women, to make a commitment to safeguarding women and their rights, that if a lady lawyer can face such horror then what about more vulnerable women in society? But once again, there was gossip for a while and some misogynistic comments too and then chatter died down.

Some might think I am virtue signalling: why didn’t YOU do anything Migara? I did a little, at that time I was myself dealing with so many different things including health issues and personal problems including grieving one of my best friends, maybe I should have done more. But I also didn’t have the same public platform at the time on IG, TikTok and YouTube. I hope that as this platform grows, so will my influence, reach, resources, abilities and then I can do more for social causes than at present, both in my capacity as a lawyer as well as a performer/video creator. I understand that at this point I have strayed away a little bit from my opening paragraph and I hope that doesn’t dilute what I’m saying, it’s just that nothing happens in a vacuum and I guess this is my stream of consciousness pouring out, hence ā€œmusingsā€

I understand that the most recent incident is particularly shocking as it occurred in broad daylight, with 2 lives lost, and in direct connection to legal duties. I condemn such an evil act. I am not trying to overshadow it or say that one incident deserves more attention than others or anything. I am also not playing a blame game and pointing figures at any specific person or societies within the legal profession.

I am merely trying to encourage people to see things differently. For lawyers to stand up for all their brothers and sisters in the profession. And in the event we see misconduct, wrongdoing in our profession we should have the courage to condemn the same as well. A lot of issues in our profession stem from state/legislature levels and the professionals alone cannot change it. But what we can change, we should, including attitudes, the culture etc: towards our fellow lawyers, towards our clients and towards our country.
