Since the mother had been the primary caregiver and no contrary medical evidence was produced, the father's appeal was dismissed. The Court emphasized that the welfare of the mentally incapacitated person is the foremost consideration.

District Police Officer, etc. Lahore High court Multan Bench Held that grown-up minor above 15 years of age cannot be forced to live with parents or be sent to a shelter home against her will, especially when she expresses fear, distress, or discomfort in the parental home. The Court observed that liberty, dignity, and mental well-being are fundamental rights, and custody disputes regarding such children should be decided by the Guardian Court in accordance with law.
