BREAKING UPDATE on Student Activist Rick Toledo:
March 6, 2026

Not only has Toledo been arrested - he is also bound by a temporary (pending the hearing) Workplace Violence Restraining Order. Not only is he faced with the civil restraining order, but it is the CA Attorney General's office which is handing that case, as attorneys representing Cal Poly Humboldt.

Following Toledo's notice of "interim suspension" from campus received on March 3rd, the graduate student has now been arrested and booked on four charges: false imprisonment (PC 236), criminal conspiracy (PC 182(a)(1)), assault (PC 240), and battery (PC 242). These charges stem from the February 27 student sit-in at Nelson Hall. as for those criminal charges - they are in the hands of Humboldt County District Attorney Stacey Eads, who confirmed that she will be making the "charging decision" in regard to which crimes to charge exactly, or not.

In response to our inquiry on the criminal charges, DA Eads responded, "An investigative report has been received from Cal Poly Humboldt Police Department and is under review. I will make the charging decision."

DA Eads has the power to approved the suggested charges, modify the charges against Toledo, drop some and keep some, or drop them all together.

The court's Restraining Order filed 3-5-26, presumably served on Toledo at the time of his arrest with the Ramey warrant signed by a local judge, prohibits Toledo from being within 20 yards of faculty member Michael Moore (Associate Director of the Gutswurrak Student Activities Center), his vehicle, home, workplace (Cal Poly) and to remain off campus - according to court filings reviewed this afternoon, at the Humboldt County Courthouse.

Stay tuned to Redheaded Blackbelt for our thorough reporting on these developments.

*BREAKING NEWS UPDATE on Robin Brooks:
March 4, 2026

One month after her written request was received by the City, Robin Brooks has been delivered an official reply from city, stating in part, "[T]he city is granting you reasonable accommodation and continues to offer you the following accommodation," listing three points: 1) a five day time extension, 2) relocation (moving help as well as "temporary shelter" meaning a hotel room) noting that "if you qualify" Arcata House "may provide some" help in moving, and 3) support services "on site" offered by AH "when available"

Ms. Brooks has now received written acknowledgment of her ADA request from the City, and a further "extension" of until this coming Sunday March 8th. The letter dated 3/3/26 addressed to Ms. Brooks informs her that "the property must be cleared" and further states that the "extension gives time to gather and move your personal property and organize any services you may need."

The "RESPONSE TO REQUEST FOR REASONABLE ACCOMMODATION" does not, however, address any direct ADA concerns presented by Brooks in her Feb. 3rd written request for ADA "reasonable accommodations" with the exception of the city conceding that "[I]f you are unable to move without assistance, medical personnel will be available to assist you."

March 2, 2026

Tomorrow may be the day Ms. Robin Brooks is removed from her 10-yr established campsite near the RR.

Since her verbal trespass warning issued by APD on 2-4-26 Robin had submitted an ADA request for reasonable accommodations from the city if they intended to remove her- which they have confirmed is the plan. Still, although she is the only encampment resident who is unable to walk- her ADA request the city has gone unanswered [UNTIL THE UPDATE ABOVE 3/3]- despite written responses being delivered by hand to other homeless campers in the area, by APD Lieutenant Scown.

For reasons unknown- despite our formal inquiry- the City has declined to address her very real ADA needs, or her written request for legally appropriate “reasonable accommodations” from a government agency intent on removing her physically from where she has lived- like it or not -for a decade, with full knowledge of the city.

An example of a written response from the city to another ADA request is shown below, along side images from Robin’s camp.

While efforts to store her belongings came together, Robin explained recently that she had been left at her camp, immobile and now without batteries to charge her electronics, to keep the heater pumping, or to provide lighting. Outreach staff from AH had assisted in removing some of her possessions, including, according to Brooks and another outreach worker with HACHR, batteries she used daily.

She was alone in the camp for the first time in a decade. She couldn’t use her heater, or charge her phone. Nobody (other than visitors) was there to help her, as Falcor was increasingly unsettled with the changing circumstances.

A van pictured below is that Arcata House Partnership- which will be tasked with relocating Robin to a temporary hotel room - only allotted for a period of 1 to 5 weeks, according to feedback provided from AHP.

After that, Robin will be put back out onto the streets of Arcata, absent some intervention from the City if Arcata, or DHHS.

Robin is terrified, and ill equipped to advocate for her own health and security apart from her ADA request.
