Facts of the Case
In the present case before the Calcutta High Court, a dispute arose between the legal heirs of a deceased person and the nominee recorded in respect of the deceased’s property / financial assets.
The nominee claimed exclusive ownership of the property on the basis of nomination, while the legal heirs asserted their succession rights under inheritance law.
Issue Before the Court
Whether a nominee becomes the absolute owner of the property upon the death of the original holder, or whether the legal heirs retain the right to inherit the property.
Decision of the Court
The Calcutta High Court held that:
Nomination does not confer ownership upon the nominee.
A nominee acts only as a trustee or custodian of the property.
The legal heirs are the real beneficiaries under the law of succession.
The nominee cannot exclude or defeat the lawful rights of legal heirs.
Key Legal Observations
Nomination is made for administrative convenience, not for transferring title.
Rights of inheritance are governed by succession laws, not by nomination.
Even if the property is transferred in the name of the nominee,
legal heirs can claim their share through due process of law.
The nominee is duty-bound to hold and distribute the property in accordance with succession rights.
