🚨 Spain's Supreme Court has annulled the national NRA/NRUA short-term rental registration system.
But before property owners celebrate, here's what the ruling actually means:
❌ It does NOT mean short-term rentals are now unregulated.
❌ It does NOT eliminate regional tourist rental licences.
❌ It does NOT allow owners to operate without complying with local rules.
What the Court ruled is that the Spanish Government could not impose a national registration system that duplicated powers already held by Spain's Autonomous Communities. The issue was jurisdiction, not the legality of holiday rentals.
For owners in Andalucía, Costa del Sol, and the rest of Spain, regional regulations, licensing requirements, inspections, and enforcement remain in force. Operating without the appropriate regional authorisation can still result in fines and sanctions.
The takeaway?
The national register may be gone, but compliance requirements for tourist rentals are very much alive.
If you own a holiday rental, continue following the regulations that apply in your region and municipality.
