POSH ACT IS NOT APPLICABLE TO POLITICAL PARTIES.... 🥲
Yes, well, not till now....
The Supreme Court recently refused to entertain a plea that wanted the political parties to comply with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, known as the POSH Act.
It court said that,
It is in the domain of the legislature and policy, and the parliament should consider it..
The petition wanted an expansive interpretation of some terms, such as ' workplace, employee, employer', as the Kerala High Court in one of its judgments refused to apply the act to political parties.
The petitioner was given liberty to challenge the HC's order and seek other available remedies.
But the question remains..
What will the courts decide ❓ ❓
Will the parliament consider this and bring a law or a policy to change the situation ❓ ❓
Because, at the end of the day, the safety and dignity of women should not depend on where they work—or who employs them. Whether in corporate offices, factories, schools, or the headquarters of a political party, the principle must remain the same: no workplace should be immune from accountability.
