AUSTIN, Texas — A jury in Williamson County has awarded a family more than $1 million in restitution for health problems caused by mold and pests in their Cedar Park apartment.

According to the lawsuit, the family sued the Whitestone Crossing apartment complex in 2022, claiming that the owner didn't repair water leaks in their apartment. The unfixed leaks then caused mold to grow, contaminated their belongings and created an uncontrollable pest problem.

The Wrights hired a company to test for mold in November 2021, according to the lawsuit. The company found the home was not habitable “and poses extreme risk to safety and health.”

Despite this finding, Baehr said, Whitestone Crossing brushed off the problem.

“The landlord said, ‘Oh, [the mold’s] not high enough ... to make a difference, so we’re not going to investigate it at all,’” she said.

In March 2019, Urbina began to feel ill. He experienced symptoms he had never felt before, including tingling sensations in his fingers that spread down his arm, numbness in his legs, severe muscle spasms that lasted multiple days, “major fatigue,” labored breathing, memory deficits, and a 20-pound weight loss. Although the medication improved his symptoms, Urbina still experienced neural inflammation, and Dr. Harbor recommended testing for mold in his apartment.

MOUNT PLEASANT — An apartment complex off Ben Sawyer Boulevard must still pay a mother and daughter $1 million for black mold exposure that left them seriously ill, a court has ruled.


The S.C. Court of Appeals on March 4 rejected a Mount Pleasant apartment complex’s appeal of a 2022 jury verdict that found it negligent in its response to Karolina and Krista Richardson’s complaints about black mold in their apartment.
