The court this morning rejected Marcellus's innocence claim, despite the revelation that the key evidence was contaminated by the original prosecution, and has decided to proceed with his execution on Sept 24th.

There’s an update here. All evidence has been presented in the new evidentiary hearing today. The judge doesn’t have to make a ruling until mid September. During the hearing today AG Bailey’s attorney argued it was “not nice” to criticize the original prosecutors for contaminating the DNA on the key piece of evidence and that it’s “normal” for them to destroy things like fingerprints. If anything they should really look into those practices… Marcellus original trial lawyer that was appointed to him testified today that he had another capital case right before this one back in 2001 and that Marcellus didn’t “get his best.” In a surprising statement, Governor Parson said yesterday that he was open to looking at clemency for Marcellus. While we wait for that and the judge’s ruling Marcellus’ execution remains on the books.

Late Wednesday, the Missouri Supreme Court ruled that the judge who vacated Marcellus Williams' death penalty sentence earlier in the day by accepting an Alford Plea must hold an evidentiary hearing first and cannot move forward with sentencing Thursday. This decision essentially puts Marcellus’s execution back on the books for now. Will update with more as I hear it.

A hearing was supposed to occur at 8:30 am this morning for Marcellus Williams to decide on if the court would allow his defense to present the DNA evidence. It’s a hearing they have been seeking for seven years and one AG Andrew Bailey has tried to stop from happening. After three hours of closed door discussions between the AG and defense / St. Louis Prosecutor (Wesley Bell) they have reached a consent agreement and the judge will now begin the hearing at 1 pm CST. I’ll give an update when we know more.
