Illegal vehicle parking on national highways is a serious road safety hazard and is a punishable offense under the Motor Vehicles Act, 1988, and the Indian Penal Code. You can report such violations to the authorities, who have the power to fine and tow the vehicles.
How to Register a Complaint
The most effective way to address the issue is by contacting the relevant authorities immediately.
National Highways Authority of India (NHAI) Helpline: For any non-emergency issue, including illegal parking or road conditions on tolled stretches of national highways, you can call the 24x7 toll-free number 1033.
Police/Traffic Police Helplines:
Dial the all-India emergency number 112 to report dangerous obstructions.
Alternatively, you can call the general police control room at 100 or your local city's specific traffic police helpline number.
Online/App-based Complaints:
Many state police departments have official e-service portals or citizen-centric apps (like "Public Eye" in some cities) where you can lodge complaints by providing details and uploading photos/videos of the violation.
The Ministry of Road Transport & Highways (MoRTH) also has an online grievance redressal system, the Centralized Public Grievance Redress And Monitoring System (CPGRAMS), where you can register a formal complaint.
In-Person Complaint: For persistent or severe issues, you can visit your nearest police station and file a formal First Information Report (FIR) or a complaint in person.
Relevant Legal Provisions
Authorities can take action under the following laws:
Section 122 of the MV Act, 1988: Prohibits leaving a vehicle in a dangerous position or in a manner that causes or is likely to cause danger, obstruction, or undue inconvenience to other road users.
Section 127 of the MV Act, 1988: Authorizes a police officer to remove and safely store any vehicle that has been abandoned or left unattended for 10 hours or more, or is parked in a legally prohibited area. The owner is responsible for all towing and storage costs, in addition to any penalties.
Section 201 of the MV Act, 1988: Stipulates a penalty of up to fifty rupees per hour for keeping a disabled vehicle on a public place so as to cause impediment to the free flow of traffic, along with the recovery of removal/towing charges.
Section 177 of the MV Act, 1988: Provides for general penalties for contraventions of the Act's rules where no specific punishment is provided elsewhere, typically involving a fine.
Section 268 of the Indian Penal Code (IPC): Defines public nuisance, which is applicable if the illegal parking causes injury, danger, or annoyance to the public.
Filing a Case in Court
While the primary enforcement action is taken by the police and traffic authorities through fines and towing, you can take further legal steps:
Magistrate Court: You can file a complaint under Section 268 or Section 290 (punishment for public nuisance) of the IPC in a magistrate's court, particularly if the police do not take sufficient action.
Public Interest Litigation (PIL): For widespread and persistent problems affecting a large number of people, a Public Interest Litigation (PIL) can be filed in the High Court or Supreme Court to compel authorities like the NHAI and police to enforce the law and remove encroachments/illegal parking.
Crucially, gather evidence such as photos (ensuring the number plate and the nature of the violation are visible), location details (landmarks, street names), date, and time before lodging your complaint.
