Karachi Must Act Before Tragedy Strikes

Karachi must stop waiting for tragedy before taking danger seriously. If a building shows repeated cracks, falling concrete, major pillar repairs, unsafe lifts, blocked exits, questionable additional construction, poor water supply or long-failed common facilities, residents should not be told to stay silent until someone dies.

Public safety begins before the accident.

The lesson is visible across Karachi. Open drains are dangerous before a child falls into them. A damaged pillar is a warning before a roof collapses. A defective lift is a hazard before an accident occurs. Citizens should be able to document these dangers, approach public authorities and, where necessary, knock on the doors of the courts before lives are lost.

The principle is reflected in Shehla Zia v. WAPDA, PLD 1994 SC 693, where the Supreme Court treated the Right to Life broadly and allowed preventive concern over a potential health hazard to be examined before catastrophe occurred. The message is simple: credible danger should be assessed before irreversible harm takes place.

The same approach is needed in residential projects such as Bisma Avenue, Gulistan-e-Johar. Concerns raised by residents include repeated structural repairs, upper-floor slab damage, major work on a lower-level pillar, lift problems, generator failure, water-quality complaints, alleged additional construction, and questions over common areas and exits. These issues should be examined by qualified independent engineers and competent authorities.

Financial accountability is equally important. Any residents’ body collecting monthly maintenance and special repair charges should have a clear legal status, registration, constitution, elected office-bearers, institutional bank account, receipts and audited accounts. If around 244 flats are charged Rs3,500 per month, the full-rate annual collection is approximately Rs10.248 million. Residents are entitled to ask how much was collected, where it was spent, which contractor was hired, and where the invoices and audit are.

Questions have also been raised about the role of former DSP Zakaullah Sangi in Bisma Avenue management. Those questions should be settled through official Sindh Police and government records, not assumptions. If permission or an NOC existed, it should be produced; if not, the competent authority should clarify the record.

The builder, including M. Saleem Patel, must also answer through documents. Original structural drawings, sanctioned plans, material specifications, completion records and handover documents should be available for inspection. If defects arose from original construction, later unauthorized alterations, extra loading or maintenance failure, an independent engineering inquiry can identify the real cause.

SBCA, KDA, KMC, Cantonment Board Faisal and other relevant authorities should respond to warnings before a disaster. Political parties including PPP, MQM and others that claim to represent Karachi should also support transparent enforcement of building safety and residents’ rights.

The purpose is not to declare anyone guilty without evidence. The purpose is to bring plans, accounts, permissions and engineering records on the table before a tragedy occurs.

My conscience does not allow me to wait for a major disaster or loss of human life before approaching the courts and authorities. If the warning signs exist today, the voice must be raised today.
