I've been noticing endless discussions about 401(k)s and IRAs, but there's a deafening silence around 412(e)(3) plans. This raises a critical question about fiduciary responsibility: Are we truly showing clients EVERYTHING available to them?
**Let's look at the numbers:**
**401(k) Plans:**
• 2025 limit: $23,500 (+$7,500 catch-up)
• Administrative fees: $45-80 per participant
• Expense ratios: 0.26%-0.60%
• Market risk: 100% participant-borne
**Traditional/Roth IRAs:**
• 2025 limit: $7,000 (+$1,000 catch-up)
• Custodial fees: $50-200 annually
• Market risk: 100% participant-borne
**412(e)(3) Plans:**
• Maximum benefit: Up to $280,000 annually
• Potential contributions: $190,000-$300,000+ per year
• Administrative costs: LOWER than traditional DB plans (no actuary required)
• Investment risk: ZERO (guaranteed by insurance contracts)

**The 412(e)(3) Advantage:**

**The Hard Question:**
If a high-earning business owner could contribute $200,000+ annually with ZERO market risk instead of $23,500 with full market exposure, shouldn't that be part of the conversation?
**Why the silence?**
• Higher setup complexity
• Requires specialized knowledge most advisors lack
• Insurance-based funding model unfamiliar to many
• Mandatory annual contributions (less flexibility)
**The Fiduciary Reality:**
As fiduciaries, we're legally obligated to act in our clients' best interests. When a 412(e)(3) could dramatically increase retirement savings capacity while eliminating investment risk, failing to explore this option raises serious questions about whether we're meeting our duty of care.

The complexity of a solution doesn't excuse us from understanding it – especially when it could be the difference between a comfortable retirement and a truly wealthy one.

Elites collaborate not compete. She's never shared anything of mine as she doesn't know I exist. However we've got the "blackmanosphere" that will come out in droves to support tearing down black women, yet won't support our black men who have credentials (outside of guys claiming to teach us how to get laid) this woman in 5 minutes has thousands of women viewing and supporting. I'm starting to think some of the ladies complaints about the lack of (B)lack men is showing itself.
