🚨 Major Legal Development at the Intersection of AI & Law

A recent federal case, United States v. Bradley Heppner (S.D.N.Y. 2026), is setting an important precedent for how courts treat AI in legal contexts.

Judge Jed Rakoff addressed a first-of-its-kind question:
Are conversations with AI tools (like ChatGPT or Claude) protected by attorney-client privilege?

The court’s answer: No.

Here’s why that matters:
• AI is not a lawyer: It has no legal duty of confidentiality
• AI is not a legal agent: It operates as a third-party service
• No reasonable expectation of privacy: Anything shared may be stored or reviewed

As a result, the court held that:
➡ Communications with AI are not privileged
➡ They may be discoverable in litigation
➡ They could potentially be used as evidence

Why this is a big deal:
This decision reinforces a fundamental legal principle, privilege depends on who you’re communicating with, not just your intent.

For professionals and clients alike, this raises a practical warning:
Treat AI interactions as potentially public-facing, not confidential legal advice.

AI made this… so why does it feel so real?

As a musician, I tried something recently that I still have not fully processed. I used an AI tool to generate two full songs from scratch, with complete instruments, lead vocals, and backup vocals, just from about two lines of prompts.

I ran them separately, of course, giving each one its own direction. The results came out as Afrobeats and R&B, following the prompts I gave them.
For the R&B track, I even added a chorus progression, doh lah fah soh, just to see how closely it would follow what I had in mind.

I was not expecting much, definitely not music. I thought I would hear something off, something that would immediately give it away as AI. Something that would make me say, this is interesting, but it is not quite there yet.

That did not happen.

It followed the prompts. It built around what I gave it. The instruments came in clean, there was a clear lead vocal, backup vocals, even moments where it slipped into pidgin English and my local dialect, Yoruba. And neither of them felt like a rough experiment. They sounded like actual songs.

That is the part I cannot shake.

Because I know what it takes to create music. The time, the human effort, and the many decisions it takes to arrive at the final sound. And here I was listening to something that skipped all of that and still made sense.

I am not going to lie, I have mixed feelings about it. Part of me is impressed. Part of me is uncomfortable. And part of me is wondering what this really means going forward.
