⚖️ 2014 की दो नियमितीकरण नीतियां सुरक्षित, एक नीति रद्द!

📍 चंडीगढ़/दिल्ली:
लंबे समय से हरियाणा के कच्चे कर्मचारियों के नियमितीकरण (Regularization) को लेकर चल रहे कानूनी विवाद पर आखिरकार सुप्रीम कोर्ट ने अपना स्पष्ट और अहम फैसला सुना दिया है।

यह फैसला हजारों कर्मचारियों के भविष्य से जुड़ा हुआ था।
जहाँ एक तरफ बड़ी संख्या में कर्मचारियों को राहत मिली है, वहीं कुछ साथियों को झटका भी लगा है।

✅ सुप्रीम कोर्ट ने क्या कहा?

साल 2014 में लाई गई तीन प्रमुख नीतियों पर फैसला सुनाते हुए कोर्ट ने कहा:

✔️ 16 जून 2014 की नीति – वैध (Valid)
✔️ 18 जून 2014 की नीति – वैध (Valid)
❌ 7 जुलाई 2014 की नीति – रद्द (Cancel)

🔹 इसका सीधा मतलब क्या है?

🎉 बड़ी राहत

जो कर्मचारी 16 जून और 18 जून 2014 की नीतियों के तहत पक्के (Regular) हुए थे —
👉 उनकी नौकरी अब सुरक्षित मानी जाएगी।
👉 उन पर मंडरा रहा कानूनी खतरा समाप्त।
👉 सेवा लाभ और पद सुरक्षित।

⚠️ झटका

7 जुलाई 2014 की नीति के अंतर्गत जिन कर्मचारियों को लाभ मिला था —
👉 उन्हें अब कानूनी चुनौती का सामना करना पड़ सकता है।

⚖️ कोर्ट का तर्क

सुप्रीम कोर्ट ने अपने फैसले में माना कि:
✔️ शुरुआती दो नीतियाँ संवैधानिक प्रावधानों और निर्धारित मापदंडों पर खरी उतरती हैं।
❌ लेकिन 7 जुलाई 2014 की नीति पूर्व दिशा-निर्देशों और संवैधानिक प्रक्रियाओं के अनुरूप नहीं थी।

*हरियाणा में ग्रुप-सी भर्ती के लिए आयोजित कॉमन एलिजिबिलिटी टेस्ट (CET) के रिजल्ट में नॉर्मलाइजेशन फार्मूला लागू करने को लेकर विवाद खड़ा हो गया है।*
*इस मामले को रोहतक के रहने वाले पवन कुमार ने पंजाब-हरियाणा हाईकोर्ट में चुनौती दी है। उम्मीदवार का कहना है कि आयोग द्वारा नॉर्मलाइजेशन फार्मूला लागू करने से परिणाम प्रभावित हुए हैं और कई योग्य अभ्यर्थियों के साथ न्याय नहीं हुआ।*

*हाईकोर्ट ने इस याचिका को गंभीर मानते हुए अर्जेंट कैटेगरी में सुनवाई के लिए लिस्टेड कर लिया है। जस्टिस संदीप मोदगिल की अदालत में इस पर सुनवाई होगी और इसके लिए 2 सितंबर की तारीख तय की गई है। चूंकि यह मामला लाखों युवाओं से जुड़ा हुआ है, इसलिए कोर्ट का फैसला अहम माना जा रहा है।*

`रिजल्ट में हो सकती है देरी`

हाईकोर्ट में मामला पहुंचने के कारण अब रिजल्ट में देरी होने के आसार हो गए हैं। हरियाणा स्टाफ सिलेक्शन कमीशन (HSSC) के चेयरमैन हिम्मत सिंह ने दावा किया था कि अगस्त के लास्ट तक आयोग ग्रुप सी के हुए एग्जाम का रिजल्ट जारी कर देंगे। आयोग की ओर से एग्जाम की आंसर की पहले ही जारी की जा चुकी है।

`करेक्शन पोर्टल खोलने की HSSC कर रहा तैयारी`

दरअसल, बीस दिन पहले हरियाणा में ग्रुप-C के पदों को भरने के लिए हुए कॉमन एलिजिबिलिटी टेस्ट (CET) के बाद अब हरियाणा स्टाफ सिलेक्शन कमीशन (HSSC) जल्द करेक्शन पोर्टल खोलने जा रहा है। आयोग के चेयरमैन डॉ. हिम्मत सिंह ने X पर पोस्ट कर इसकी जानकारी दी।

उन्होंने अभ्यर्थियों को अपने सभी जरूरी डॉक्यूमेंट और सर्टिफिकेट पहले से तैयार रखने की सलाह दी, ताकि पोर्टल खुलते ही उन्हें अपलोड कर परिणाम जारी करने की प्रक्रिया में देरी न हो।

नॉर्मलाइजेशन लागू करने का आयोग दे चुका जानकारी
इससे पहले आयोग चेयरमैन ने बताया कि इस बार परीक्षा में नॉर्मलाइजेशन फॉर्मूला लागू होगा। इससे चारों शिफ्टों में हुए पेपर की कठिनाई के आधार पर अंक बराबर किए जाएंगे।

चेयरमैन ने इस प्रक्रिया पर अभ्यर्थियों से कानूनी रूप से मान्य सुझाव भी मांगे हैं। साथ ही भरोसा दिलाया है कि नॉर्मलाइजेशन के बाद किसी को शिकायत का मौका नहीं मिलेगा।
