Not guilty by reason of insanity—means the court has determined that, at the time of the offense, the person lacked the legal capacity to understand the nature or wrongfulness of their actions. That finding results in involuntary commitment, not voluntary treatment. The individual is placed under the authority of the state, often in a forensic psychiatric hospital, with no set release date.
Unlike a typical patient, their confinement is tied to public safety and court oversight, not personal treatment choices. Release occurs only after repeated evaluations, court hearings, and a finding that the person no longer poses a risk—something that can take longer than a prison sentence and, in some cases, lasts for decades.
That is precisely why most defendants do not plead insanity. It carries a higher burden of proof, removes personal autonomy, and often results in indefinite confinement with fewer rights than incarceration.
So while medical care is involved, it is not comparable to being a standard patient under a doctor’s care. It is a legal status with profound and lasting consequences.
