The Supreme Court has ruled that a man and his relatives may face prosecution under Section 498A of the IPC, or Section 85 of the Bharatiya Nyaya Sanhita, for subjecting a woman in a marriage-like live-in relationship to cruelty.

Section 498A was introduced to protect women from abuse and harassment by their husbands or their husbands’ family members.

The court clarified that the protection can extend to live-in relationships that bear the characteristics of a marriage, including long-term cohabitation, mutual commitment and shared domestic responsibilities. It observed that women in such relationships should not be deprived of legal safeguards solely because the relationship was not formally registered as a marriage.
The ruling seeks to ensure that women in vulnerable domestic relationships have access to legal protection and remedies against abuse.

“When the objective of the Section 498A was to provide coverage to those cases where harassment by husband or in-laws through wilful conduct causing mental or physical injury or driving the woman to suicide, then to say that such harassment can only be caused when they are married and not before that, in our considered view, would be a case of over simplification… This distinction between ‘married’ and ‘live-in relationship in the nature of marriage,’ in as much as it relates to the protection envisaged by Section 498A, has no rational nexus with the object of preventing domestic violence and is as such offensive to Article 14 of the Constitution of India,” observed a bench comprising Justice Sanjay Karol and Justice Nongmeikapam Kotiswar Singh.

A Delhi court acquitted former Wrestling Federation of India (WFI) chief and BJP leader Brij Bhushan Sharan Singh in the sexual harassment case filed by several women wrestlers.

The court held that the prosecution had failed to prove the charges beyond reasonable doubt and extended Singh the benefit of the doubt.

The case stemmed from allegations made by six women wrestlers, who accused Singh of sexual harassment, stalking and intimidation during training camps, tournaments and official events over several years.

Their complaints led to month-long protests in Delhi in 2023, with Olympic medallists and international wrestlers, including Sakshi Malik, Vinesh Phogat and Bajrang Punia, demanding Singh's arrest and the dissolution of the Wrestling Federation of India leadership.

Singh was chargesheeted under provisions relating to sexual harassment, use of criminal force with intent to outrage modesty, stalking and insulting the modesty of a woman. He consistently denied all allegations, calling them politically motivated.

After examining the evidence and witness testimonies during trial, the Delhi court concluded that the prosecution had not established the charges beyond reasonable doubt and acquitted Singh of all offences in the case.
