Florida Families Need Real Accountability: Strengthen and Enforce Child Protection Laws Now!
Governor Ron DeSantis just signed a bill to increase penalties for “swatting” - a necessary move to deter false emergency reports that endanger lives. But Florida’s families still face a deeper and ongoing crisis: false allegations in child custody and abuse cases are weaponized every day with no real accountability.
✅ Under Florida Statute § 837.05, knowingly making a false report to law enforcement is a third degree felony
✅ Under § 39.205(9), making a false report of child abuse, abandonment, or neglect is also a third degree felony
⛔ Yet these laws are virtually never enforced, especially in family law cases, because prosecutors must prove intent - a nearly impossible burden
📉 There is no accountability for reckless, negligent, or strategic false reports, even if the child and parent suffer trauma, alienation, or loss of custody as a result
Meanwhile, Florida Statute § 787.03, which criminalizes interference with lawful custody, is ignored or misclassified as a "civil" issue by law enforcement - even though it's a crime to violate a parenting plan or final judgment. Protective parents are sidelined while manipulative actors exploit legal gray areas.
➡️ These contradictions violate:
Florida victims’ rights under Article I § 16 of the Florida Constitution
Law enforcement’s duty to enforce custody orders (§§ 741.29, 943.171, 839.24)
Children’s fundamental right to maintain relationships with safe, lawful parents
Due process protections, as recognized in cases like Shaw v. Shaw, Davila, and Lafleur
Governor DeSantis: If protecting the public from swatting is worth a legislative act, protecting Florida’s children from malicious family court abuse deserves the same urgency.
We urge your administration to act immediately:
🔹 Direct DCF and law enforcement to consistently enforce § 787.03 when custody orders are violated
🔹 Expand § 837.05 and § 39.205(9) to cover reckless and malicious false reporting, not just provable intent
🔹 Require judicial findings before treating any custody or abuse allegation as credible in pending disputes
False reporting is not just a lie -it’s a weapon that destroys families, manipulates courts, and overwhelms agencies already spread too thin.
Florida can and must lead the nation in protecting both children and constitutional rights by closing these dangerous loopholes and enforcing the laws we already have.
