In Nigeria, various land documents play a crucial role in establishing ownership, rights, and interests in land. These documents are essential for legal purposes, property transactions, and dispute resolution. Below are some of the key land documents in Nigeria, along with their importance and differences:



𝗖𝗲𝗿𝘁𝗶𝗳𝗶𝗰𝗮𝘁𝗲 𝗼𝗳 𝗢𝗰𝗰𝘂𝗽𝗮𝗻𝗰𝘆 (𝗖 𝗼𝗳 𝗢)
The Certificate of Occupancy is the most important land document in Nigeria. It is issued by the state government and serves as evidence of legal ownership of land in urban areas. The C of O grants the holder exclusive rights to use, occupy, and develop the land for a specified period, usually 99 years. It offers better security and protection for landowners, making it an attractive option for investors and property developers.



𝗗𝗲𝗲𝗱 𝗼𝗳 𝗔𝘀𝘀𝗶𝗴𝗻𝗺𝗲𝗻𝘁
A Deed of Assignment is a legal document used to transfer ownership of land or property from one party to another. It is typically used for land in rural or undeveloped areas where a Certificate of Occupancy might not be available. The deed is executed between the assignor (seller) and the assignee (buyer) and must be properly registered to be valid. While it doesn’t grant ownership rights like a C of O, it establishes a legally recognized transfer of ownership.



𝗗𝗲𝗲𝗱 𝗼𝗳 𝗖𝗼𝗻𝘃𝗲𝘆𝗮𝗻𝗰𝗲
Similar to the Deed of Assignment, a Deed of Conveyance is used to transfer ownership of land from one party to another. However, it is typically applied to properties that have already been granted a C of O but are being transferred between parties. The Deed of Conveyance is executed through a lawyer and must also be registered to be legally enforceable.



𝗦𝘂𝗿𝘃𝗲𝘆 𝗣𝗹𝗮𝗻

A Survey Plan is a graphical representation of the boundaries and measurements of a piece of land. It is essential for defining the exact dimensions and location of the property and is required for property registration and land transactions. A certified survey plan helps to prevent boundary disputes and ensures clarity in property ownership.



𝗚𝗮𝘇𝗲𝘁𝘁𝗲
A Gazette is an official publication by the government that declares certain areas as public land, private land, or government-acquired land. It is used to notify the public about land acquisitions and reservations and is a critical document for establishing the status of land. Properties in government gazetted areas may have certain restrictions on their use and development.



𝗚𝗼𝘃𝗲𝗿𝗻𝗼𝗿’𝘀 𝗖𝗼𝗻𝘀𝗲𝗻𝘁
Governor’s Consent is a legal requirement for certain land transactions involving land with a Certificate of Occupancy. It is the formal approval of the state governor for the transfer, assignment, or mortgage of land. Without Governor’s Consent, such transactions may be deemed invalid, making it essential for securing property rights.



In summary, these various land documents in Nigeria play distinct roles in establishing and protecting land ownership rights. The Certificate of Occupancy is the most secure document, granting ownership rights for a specified period, while the other documents facilitate the transfer, identification, and use of land in different circumstances.
