⚖️ Tahsildar Singh v. State of U.P.
AIR 1959 SC 1012
A landmark decision concerning the evidentiary value and use of statements recorded by the police under Section 161 CrPC.
The Supreme Court clarified that a statement recorded under Section 161 CrPC is not substantive evidence and cannot be used to corroborate the testimony of a witness. Its use is limited, particularly for contradicting a witness in the manner provided by law.
📌 Section 161 CrPC → Section 180 BNSS
The judgment is widely regarded as the “Bible” on the law relating to the use of statements recorded under Section 161 CrPC.
