This is your friendly reminder to make sure your pipes are covered, your faucets are dripping, and that your heat is left on. I can't tell you how many times I see water running out of a person's house or garage because they failed to insulate their exposed pipes and faucets. That's why I love the note business when compared to rentals. Nobody calls the bank when a pipe bursts but they sure will call the landlord and it's never at a good time!

In 2010, while living briefly in South Florida, I had an appointment with the President of a now-closed bank in Naples, FL. Upon seeing my youthful appearance, he skeptically asked, "What the hell do you know about notes?"

I replied, "Based on your most recent FDIC filing, I see you have over $70 million in NPNs worth about 30 cents on the dollar. If you want to offload them before going belly-up, you'll need investors like me to take a look."

After a brief silence, he said, "Follow me."

We entered a conference room with a 20-foot-long table piled high with vanilla folders and loan files. He handed me a list of notes and left, grumbling that his assistant could assist me.

Over the next few months, I bought and brokered some of his NPNs. More importantly, he connected me with over a dozen local colleagues from other troubled banks, allowing me to help them move their distressed residential and commercial real estate portfolios.

Are we back to where we were in 2010? Not quite, but opportunities are increasing, with more NPNs entering the market for investors. My biggest regret is not buying more notes back then. While we may not be acquiring notes at pennies on the dollar as before, there are still numerous excellent deals available for those who know where to look and identify who is in trouble. Just this week, we received a list of over 4,000 notes from one lender to choose from.
