Command the Courtroom

As a family law attorney I often see people who are representing themselves in a child custody case 'crash and burn' because they don't know what to say, do or present to the judge in their cases. Sadly, judges' decisions don't always reflect what is best for the children because parties haven't presented the information the judge needs to make the RIGHT decision. In these short tutorials I want to show people who can't afford to hire a lawyer the absolute best way to build a custody case and increase their chances at success

Command the Courtroom

Hi there, my friend,

The pressure of a custody case is heavy.

I feel the weight, too. Sometimes it gets to me, as well. Still, I won't stop fighting for what is right. Neither should you.

Over the years, I've been able to work with so many clients I love and admire. Despite huge setbacks and slow progress, there were a handful of clients who continued to "roll with the punches"... no matter what.

Did I ever see these clients get down? Yes.

Did they feel like all hope was lost at times? Also yes.

Did I ever see them reduced to tears and in despair? Yes.

However, what amazed me about these super-resilient clients was their ability to "come back" again and again and again...(Kind of like "The Terminator" in one of my favorite, but as I now look back, very hokey 80s movies.)

When I've asked these clients how they managed to keep coming back, there were a few things I noticed they had in common:

First, they made working on their emotions and mental state a habit. They were always trying to improve. They asked how they could get better. They changed behaviors if they thought it would lead to a better life for their kids or increased the chances of an improved case result.

Second, they refused to relive the past over and over and over again. They were able to get to a point where they could objectively view their past experiences (even with an abusive ex) as "information" without an emotional charge. They used this "information" to inform the present and strategize about the future.

Third, they took full accountability for their own words, behaviors and actions when it was appropriate. They did not spend most of their time blame-shifting or judging others. They recognized that the only thing they have control over was their own emotions and they focused more of their energy on controlling their reactions and brainstorming solutions.

Interestingly, with all of these clients, although things may not have gone perfectly at the end of the case, they still found peace in the outcome. They also held hope for a better future.

Anyway, I'm not sure if these thoughts will be helpful to you, but having the gift of working with this rare "breed" of client has certainly helped me grow, not only as an attorney, but also as a person.

Life isn't perfect. The way cases unfold are certainly FAR from perfect and yes, it REALLY pisses me off sometimes.

Still though, like the Terminator, I'm going to keep coming back for more - because it's the right thing to do.

Will you do the same?

Hasta la vista, baby,

Wendy

Do you think gender bias is alive in today's custody courtrooms? Do you think that you could be hurt (or helped) in your case by the mere fact that you're a man or a woman?

Last week I interviewed Ashley-Nicole Russell, Esq, divorce attorney, and host of the Divorce, Healthy! Podcast. Here is a segment from that interview where we talked about how divorce today pretty much equals conflict, and how we got to where we are today.

If you're going to advocate and negotiate that you should get an equal parenting time arrangement or shared custody or perhaps the other parents should not get any parenting time or supervised parenting time, you have to be not only convinced in your heart of hearts but you have to be able to articulate it to the judge.

In case you missed it, I had the opportunity to talk to my very special guest, Tina Swithin, founder of ‪@OneMomsBattle‬ and author of many books including her first book, "Divorcing a Narcissist: One Mom’s Battle" and most recently, her favorite book to date, “The Narc Decoder: Understanding the Language of the Narcissist.” Tina shares with me when her journey with the narcissist in her life began and how she ended up where she is today.
