20. Justifiable homicide

A. A homicide is justifiable:

(1) When committed in self-defense by one who reasonably believes that he is in imminent danger of losing his life or receiving great bodily harm and that the killing is necessary to save himself from that danger.

(2) When committed for the purpose of preventing a violent or forcible felony involving danger to life or of great bodily harm by one who reasonably believes that such an offense is about to be committed and that such action is necessary for its prevention. The circumstances must be sufficient to excite the fear of a reasonable person that there would be serious danger to his own life or person if he attempted to prevent the felony without the killing.

(3) When committed against a person whom one reasonably believes to be likely to use any unlawful force against a person present in a dwelling or a place of business, or when committed against a person whom one reasonably believes is attempting to use any unlawful force against a person present in a motor vehicle as defined in R.S. 32:1(40), while committing or attempting to commit a burglary or robbery of such dwelling, business, or motor vehicle.

(4)(a) When committed by a person lawfully inside a dwelling, a place of business, or a motor vehicle as defined in R.S. 32:1(40) when the conflict began, against a person who is attempting to make an unlawful entry into the dwelling, place of business, or motor vehicle, or who has made an unlawful entry into the dwelling, place of business, or motor vehicle, and the person committing the homicide reasonably believes that the use of deadly force is necessary to prevent the entry or to compel the intruder to leave the dwelling, place of business, or motor vehicle.

(b) The provisions of this Paragraph shall not apply when the person committing the homicide is engaged, at the time of the homicide, in the acquisition of, the distribution of, or possession of, with intent to distribute a controlled dangerous substance in violation of the provisions of the Uniform Controlled Dangerous Substances Law.


It is necessary to consider the following when examining a claim of self-defense: (1) whether the defendant reasonably believed he was in imminent danger of death or great bodily harm, (2) whether the killing was necessary to prevent death or great bodily harm, and (3) whether the defendant was the aggressor in the conflict. State v. Alfred, App. 3 Cir.2023, 358 So.3d 957, 2022-477 (La.App. 3 Cir. 3/1/23).

For a person to assert justifiable homicide under shoot-the-intruder law, allowing a defense against homicide against a person who is attempting to make an unlawful entry into the dwelling, place of business, or motor vehicle, there is no need for the person using deadly force to believe that he is in danger of losing his life; instead, the person need only reasonably believe that the use of deadly force was necessary to prevent the entry or to compel the intruder to leave the premises or motor vehicle. State v. Gasser, App. 5 Cir.2019, 275 So.3d 976, 18-531 (La.App. 5 Cir. 7/3/19)

Even a drug dealer who commits a homicide during a drug deal can claim self-defense if he believes his life is in danger. State v. Cook, App. 2 Cir.2012, 86 So.3d 672, 46,843 (La.App. 2 Cir. 1/25/12)

“Drug sale exception” to justifiable homicide applies only when homicide is committed by someone lawfully inside a home against a person who has made an unlawful entry into the home, and not to the three other distinct instances of justifiable homicide set out in governing statute. State v. Cook, App. 2 Cir.2012, 86 So.3d 672, 46,843 (La.App. 2 Cir. 1/25/12)

Even a drug dealer who commits a homicide can still claim self-defense if he believes his life is in danger, he is simply not entitled to the lessened “shoot-the-burglar” standard under the fourth instance of justifiable homicide set out in the governing statute. State v. Revish, App. 1 Cir.2015, 185 So.3d 8, 2015-0470, 2015-0471 (La.App. 1 Cir. 11/9/15)



When evidence of a victim's dangerous character is offered to explain defendant's reasonable apprehension of danger, such evidence may be introduced to show the accused's state of mind only if it is shown that the accused knew of the victim's reputation at the time of the offense. State v. Black, App. 1 Cir.2005, 907 So.2d 143, 2004-1526 (La.App. 1 Cir. 3/24/05)

Evidence of general reputation of deceased for violence under particular circumstances is admissible on issue of self-defense. State v. Domingue, Sup.1928, 166 La. 859, 118 So. 46.

In prosecution for murder defended on ground of self-defense, though law does not demand of defendant the same coolness and judgment in estimating his danger that jury could exercise, whether defendant had reasonable grounds to believe himself in danger was jury question. State v. Abadie, 1880, Man.Unrep.Cas. 316; State v. Thornhill, 1938, 188 La. 762, 178 So. 343.

🚨🚨Penalties for not filing a Beneficial Ownership Information (BOI) report can be civil or criminal🚨🚨

📍Civil penalties: As of January 25, 2024, the civil penalty for each day a BOI report is late is $591, up from $500 previously. The maximum civil penalty is $10,000.

📍Criminal penalties: For willful failure to file a BOI report, the criminal penalty is up to two years in prison and a fine of up to $10,000

For my business owners in anywhere here are Step-by-Step Instructions on how to file yours:

🖇️Access the portal: Go to "boiefiling.fincen.gov/fileboir" on your web browser.

🖇️Start filing: Click on "Prepare & Submit BOIR".
Enter business details:

🖇️Provide your business name.

🖇️Input your EIN or Social Security Number.

🖇️Select the state as "Your STATE".

🖇️Fill in your complete business address.

🖇️Identify beneficial owners:

🖇️For each beneficial owner, provide their full name, date of birth, and address.

🖇️Enter the type of identification used (driver's license, passport etc.) and upload a copy if required.

🖇️Review and submit:

🖇️Carefully review all the information you have entered for accuracy.

🖇️Click "Submit" to electronically file your BOI report.

📌Key points to remember:

❌No physical filing: You cannot mail or fax a BOI report; it must be submitted online through the FinCEN portal.
