COURT UPHOLDS VALIDITY OF NEW JEANS' EXCLUSIVE CONTRACT WITH ADOR
ADOR did what it was supposed to do, so it doesn’t amount to a breach of duty. The remark about “abandoning NewJeans and so on” was found, upon reviewing the context of the report, to have arisen during the process of presenting a strategy for LE SSERAFIM. Given that HYBE invested over 21 billion KRW and achieved success, it is difficult to conclude that HYBE intended to abandon NewJeans. ADOR also presented comeback strategies to NewJeans, and surveys on celebrity preference showed that NewJeans ranked first in popularity. Future strategic responses were also discussed. There is insufficient evidence to conclude that they obstructed ADOR’s promotions, that Bang Si-hyuk ignored greetings, or that they unfairly interfered with advertising and ambassador offers such as the Apple campaign.
The defendant shall bear the litigation costs.

NewJeans' side releases official statement following court's decision, asserting they will not return to ADOR and confirming they will file an appeal: — "The members respect the court's judgment, but maintain the position that it is impossible to return to ADOR and continue normal entertainment activities in the current situation where the relationship of trust with ADOR has been completely broken. Accordingly, the members plan to immediately appeal the first-instance ruling and hope that the appellate court will comprehensively review the facts and the legal principles regarding the termination of the exclusive contract once again to deliver a wise judgment. Finally, we express our sincere gratitude to the fans who have waited and supported us for a long time. Thank you."
At the end of the ruling, the court stated, “In cases like NewJeans, where the management contract is signed before debut, it is common for large-scale investments to be made under uncertain prospects of success, and such investments can only be recouped if the artist succeeds.” The court added, “Therefore, the fact that excessive demands were not accepted cannot be interpreted as ‘being forced into exclusive activities against one’s free will’ or as ‘a violation of personal rights.
