Investigative Report Delves Into the Outdated United States Cash Bail System
@MNNYouTube, August 8, 2023: The Investigative Report program on MNN has put together a piece detailing the investigation of the legality of the current U.S. cash bail system.
Each year over 7,000,000 persons await trial in state and local jails without having been charged. Some of these people are being held because they could not afford the monies to be bailed out before their court date.
In the Land of the Free, some remain in prison until trial, while others who have committed the same crimes go free until their days in court because they have the cash or assets to secure their freedom. Opponents of this cash bail system – which remains unchallenged by any modern Supreme Court – maintain that it disproportionately burdens marginalized communities who cannot afford to buy their way out of prison.
A Drexel Law Review study states that under the Equal Protection Clause of the Fourteenth Amendment of the U.S. Constitution, the cash bail system is unconstitutional because it impermissibly discriminates against indigent persons. Moreover, it fails under heightened scrutiny.
