That the present Writ Petition is filed by the Petitioners, who had appeared in the Teachers Eligibility Test, 2022 (TET, 2022) conducted by the Respondent West Bengal Board of Primary Education (WBBPE). The Petitioners challenge the legality, fairness, and credibility of the so-called âExpert Committee Reportâ published in relation to disputed questions of TET, 2022, which has resulted in the arbitrary and unjust exclusion of the Petitioners from the ongoing recruitment process for primary teachers against 13,421 vacant posts.
That after the declaration of results of TET, 2022, several serious errors, discrepancies, and patent printing mistakes were noticed in multiple questions and answer options. The Petitioners raised specific and reasoned objections, including the existence of multiple correct answers, acknowledged printing errors, and incorrect evaluation. Acting upon such grievances, this Honâble Court was pleased to constitute Expert Committees to examine the disputed questions.
That despite clear judicial directions and despite the acknowledged existence of printing errors in the question booklet, the so-called Expert Committee Report, filed after an inordinate delay, is ex facie arbitrary, biased, inconsistent, and suffers from non-application of mind. The Report ignores the Petitionersâ specific submissions, fails to provide cogent reasons, contains handwritten insertions in typed text, and includes a member affiliated with the Respondent Board, thereby vitiating the very foundation of impartiality and fairness.
That the Report was placed before the learned Single Judge without affording the Petitioners any opportunity of hearing or rebuttal, in complete violation of the principles of natural justice. The Petitioners have therefore been compelled to assail the said Report through the present writ petition.
That while the legality of the impugned Report remains sub judice, the Respondent Board has issued a fresh recruitment notification for appointment of primary teachers against **13,421 vacant posts**, and has commenced the selection process. Solely on the basis of the impugned and faulty Expert Report, the Petitioners have been illegally excluded from participation in the interview stage, thereby causing them irreparable injury and rendering the entire writ petition infructuous if interim protection is not granted.
That it is a settled principle of law that candidates should not be penalised for errors committed by the examining authority, particularly in cases of admitted printing errors. In such circumstances, the only fair and equitable course is **distribution of marks for the printing-error questions to all candidates**, so that meritorious candidates are not arbitrarily deprived of their rightful consideration.
That denial of interview opportunity to the Petitioners, despite the existence of serious doubts over the correctness of the evaluation process, amounts to hostile discrimination, arbitrariness, and violation of Articles 14 and 16 of the Constitution of India. The Petitioners are otherwise fully eligible and qualified, and their exclusion at this stage will cause irreversible prejudice.
That unless this Honâble Court is pleased to grant **interim relief** by directing the Respondents to permit the Petitioners to participate in the interview process in the ongoing recruitment against 13,421 vacancies, and to apply fair mark distribution for the printing-error questions, the entire writ petition will be rendered illusory, and the Petitioners will be permanently deprived of their legitimate rights due to a demonstrably biased and flawed process.
